What does Asylum stand for?

Asylum means “Protection granted by any state to someone who has left their home country in fear of being prosecuted or on a political ground”. If you are going through this risk any country can grant you asylum on the basis of your fears.

In the UK an “asylum seeker” is the person who is waiting for the decision of the claim. So, when they receive a positive decision on their claim, they gain the status of a refugee. Some asylum candidates might have entered the UK illegally but after applying asylum they will no longer be illegal. Till the time of the asylum claim decision everyone is allowed to stay in the UK under protection.

Asylum Application Process:

According to law it is not possible for Asylum seekers to apply from outside UK, as all the decision and claims are made here. So, once they apply for asylum they are protected on the basis of human rights.

As soon as asylum seeker arrives, he or she should make claim to an Immigration officer. After passing through immigration control, they must visit and ask for asylum claim at UK Border Agency.

New Asylum Model (NAM) has been introduced for dealing with asylum claims at Home Office in 2007. “Case owner” is a specific member of UK Border Agency staff to whom asylum application has been assigned.

UK Border Agency will take your screening interview along with personal details, story of your journey and confirming your earlier asylum claim to Europe or UK in order to give reference number for the application.

An applicant at their “substantive interview”, or “asylum interview” is to explain their situation regarding the fear of living in their own country.
The applicant must be part of regular reporting meetings with local UK Border Agency staff. On the basis of the screening interview some immigrants are sent to Harmondsworth Immigration Removal Centre or Yarl’s Wood Immigration Removal Centre to be fast-tracked.

How a decision is made by UKBA:

For successful asylum claims all the points mentioned below play an important role:

  • The harmful treatment the person fears amounts to ‘persecution’
  • The person’s fear of such persecution is ‘well-founded’
  • The persecution is for one of the five reasons specified in the Convention
  • The person could not find protection in another part of their country
  • The person would be at risk of experiencing such persecution in the future if they were returned.
